When Influencers Become Targets: The Hidden Struggle for Justice Under India’s PoSH Act

A popular social media influencer, was filming a video in a bustling market when the unthinkable happened, she was groped by a man. Stunned and overwhelmed, she froze, knowing she had just been violated but unsure where to seek help. As an influencer without a traditional employer or HR department, accessing justice became a complex challenge. This incident highlights a larger issue for gig workers, influencers, and women in the unorganised sector, who face increased vulnerability to workplace harassment. While the Prevention of Sexual Harassment Act, 2013 (“PoSH”) offers legal protections, navigating the system remains difficult. Women in the informal sector are required to file complaints with Local Complaints Committees (“LCCs”). However, with only 29% of districts having established LCCs and many victims unaware of their existence, justice remains out of reach for most. This points to an urgent need for reform: LCCs must be strengthened, better funded, and adequately trained to handle harassment cases with sensitivity and efficiency. These critical issues were discussed on November 8, 2024, at a panel hosted by Vijay Foundation on "Empowerment of Women: PoSH Challenges and Concerns." Moderated by Bridge’s honorary director Ms. Kritika Krishnamurthy. The session featured distinguished panellists including Justice Neena Bansal Krishna, Ms. Vimla Mehra, IPS officer (Retd) and Ms. Nandani Rao, Social rights activist.
